These My Business Design, LLC Terms of Service (“Terms”) constitute a legally binding agreement between you and My Business Design, LLC (including its affiliates, referred to as “we,” “us,” or “our”) and govern your purchase, receipt, and use of any credit redeemable for our services (“Service Credit”).

By purchasing, receiving, or using our products, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as any other terms and policies that govern your use of our services. If you do not agree to these Terms, you should not purchase or use our services or products.

Capitalized terms used but not defined in these Terms will have the meanings assigned to them in the My Business Design, LLC Service Agreement (the “Agreement”), which governs your use of the applicable services.

Our services operate on a monthly subscription model, which requires users to prepay for access each month. When you subscribe to a service plan, you agree to recurring monthly billing unless you cancel before the next billing cycle.

• Subscription Renewal: Your subscription automatically renews each month on the billing date associated with your account unless canceled before renewal.

• Billing Authorization: By enrolling in a subscription, you authorize us to charge your payment method on file for the applicable fees.

• Cancellation: You may cancel your subscription at any time, but cancellations take effect at the end of the current billing cycle. No refunds or prorated credits will be issued for the remaining days in your subscription term.

Prepaid Service Credits may be instituted to allow you to purchase access to certain future features or services in advance. These credits can be applied toward any eligible service as we deem allowable.

• Service Credits do not replace monthly subscription fees.

• No Cash Value: Service Credits are not redeemable for cash or any monetary value.

• Expiration: Unused prepaid credits expire one (1) year from the date of purchase unless otherwise stated at the time of issuance.

We may issue Promo Credits as part of promotional programs. These credits:

• Are provided free of charge and cannot be exchanged for cash or other services.

• May be subject to additional restrictions, including expiration dates and service limitations.

• Cannot be used to offset taxes, fees, or transaction-based charges.

Our services, including access to Service Credits and subscription-based features, are provided on an “as available” basis. While we strive to maintain high uptime and reliable access, we do not guarantee uninterrupted service.

• Planned Maintenance: We may schedule maintenance or updates to improve our services, which could result in temporary downtime. We will make reasonable efforts to notify users in advance of planned maintenance.

• Unplanned Downtime: Unexpected service disruptions may occur due to server failures, third-party hosting issues, cyberattacks, or force majeure events (e.g., natural disasters, power outages).

• No Compensation for Downtime: While we aim for maximum service availability, we are not responsible for any losses, refunds, or credits resulting from service interruptions, including any inability to use prepaid or promotional credits.

• User Responsibility: You acknowledge that internet connectivity, hardware malfunctions, and third-party services may impact your ability to access our platform, and these are outside of our control.

• If you experience service disruptions, you may contact My Business Design, LLC Support for assistance. While we will make reasonable efforts to resolve issues, we do not guarantee immediate resolution.

• • Not a Currency: Service Credits are not legal tender, digital currency, or any form of stored value. They have no equivalent value in fiat currency and do not act as a substitute for any financial instrument.
  • Non-Transferable: Memberships and future service credits cannot be transferred, sold, gifted, or traded to any other person or entity. They may only be used by the original account holder for the designated services.
  • No Ownership Rights: Possession of a Membership or Service Credits does not confer any property rights or ownership interests in My Business Design, LLC or its services.
  • Limited Use: Service Credits may only be used in connection with eligible services and cannot be applied to third-party fees, external purchases, or services outside of our platform.

• All Sales Are Final: All purchases of prepaid services, including Service Credits, are final. No refunds, reversals, or exchanges will be granted for unused Service Credits, except as required by law.

• Expiration Policy: Unless otherwise stated at the time of purchase, Service Credits expire one (1) year from the date of purchase or issuance if not used. After expiration, unused credits will be forfeited and will not be reinstated.

• Refund Exceptions: In rare cases, we may offer refunds at our sole discretion, such as in the event of a technical error where Service Credits were not properly applied to an account.

• Unauthorized Transfers: We strictly prohibit the sale, transfer, gifting, or exchange of Service Credits in any form.

• Violations and Consequences: Any attempt to use, sell, or transfer Service Credits outside of authorized channels may result in immediate revocation, termination, or cancellation of your Service Credits and/or your account.

• Enforcement Actions: We reserve the right to suspend or terminate your account and forfeit any remaining Service Credits if we detect fraudulent, abusive, or prohibited use of our credit system.

• We reserve the right to suspend or terminate your access to services in accordance with the My Business Design, LLC Service Agreement, which includes the ability to:

  • Suspend or terminate your Service Credit balance if required by applicable law.
  • Deny the use of Service Credits if they are obtained through unauthorized means.
  • Modify or discontinue the Service Credit system at any time.

• We may modify these Terms at any time by:

  1. Posting a revised version on our website, or
  1. Sending email notification to the address associated with your account.

  Any modifications will take effect immediately upon posting or, if notified by email, as stated in the message. By continuing to receive or use Service Credits after the effective date of the modifications, you agree to the revised Terms.
